Kerala HC Sets Aside KUHS Homoeopathy PG Board Decision on Separate Minimum Marks

As per the recently approved MD Homoeopathy syllabus by the KUHS Homoeopathy Board of studies, 50% marks are essential in all papers to pass Part II MD Homoeopathy examinations.

However, as per the gazetted regulations of KUHS, the candidate should have a 50% minimum in the subject and there is no requirement for having a 50% minimum in each paper of a subject. As per the NCH regulations also, an aggregate 50% is sufficient to pass the examinations; no separate minimum is required.

Dr. Arshida P, an MD Homoeopathy examination candidate from GHMC Trivandrum, challenged the KUHS decision in the Kerala High Court. The court categorically stated that a separate minimum in each paper is not required, but an aggregate of 50% per subject is sufficient.

In other streams like Ayurveda and Modern Medicine, 40% aggregate is sufficient to pass the MD examinations.

Advocate Sajeev Kumar K. Gopal appeared for the petitioner. Honorable Judge Sri. TR Ravi issued the judgment on WP(C) No. 29483 of 2023.
